“We are working with the government of Kenya to
see if we can refine the process for either prosecuting
these individuals or extraditing those individuals for
prosecution elsewhere,” said Michel, who noted there
were IMO-supported efforts under way for a regional
memorandum of understanding (MOU).
“This MOU would assist in capacity building, to
help them build their patrol forces and judicial systems to be able to deliver consequences to the pirates,” he said.
Among the many nations and stakeholders in the
region who were invited to participate were France,
Yemen, Saudi Arabia, Djibouti, Eritrea, Kenya,
Tanzania, Madagascar and South Africa.
“Until the pirates know that there is a consequence for
getting caught, they are going to keep doing what they
are doing,” Michel said. “And the only way that I can see
to deliver consequences to them in a meaningful, systematic fashion is to set up the appropriate legal mechanism and put people in jail for a long time.” ■

Pirates leave the merchant vessel MV Faina for the Somali
shore Oct. 8 while under observation by the U.S. Navy. The
Belize-flagged cargo ship is owned and operated by Kaalbye
Shipping, Ukraine, and is carrying a cargo of Ukrainian T-72
tanks and related military equipment. The ship was seized by
pirates Sept. 25 and still was being held as of mid-January.
